One element of this is the complaint reporting system, the online platform you’re now visiting.
You may use this platform or the answering machine at 06 1 391 4715 to report any actions that may have affected you or you may have experienced that fall within the scope of Act XXV of 2023 on reporting matters of public interest and rules relating to any abuse (hereinafter: the Act), which are related to the tasks performed by the Association of the Hungarian Charity Service of the Order of Malta.
Please note that in all cases where the action you have reported gives rise to a reasonable suspicion of a criminal offence that is not punishable solely based on a private request for prosecution (in criminal law, this means the victim’s claim to prosecute and punish the perpetrator), the Association of the Hungarian Charity Service of the Order of Malta will file a police report on the specific case in accordance with the law, depending on the outcome of the investigation carried out on the basis of your report.
You can use this platform to report any alleged abuses or complaints that fall within the scope of the Law, furthermore the platform facilitates the reporting of suspicions that may relate to abuses of a sexual, financial or need-based in nature.
The rules on reporting procedures, the conduct of the investigation and the processing of the data provided to us (“Policy on the Procedures of the Hungarian Charity Service of the Order of Malta for the investigation of complaints received to the internal complaint mechanism established by the employer”, hereinafter: Policy) can be found here.
If possible, please include all the necessary details in your report: the place and time of the act, the persons involved or informed, and any other circumstances that may help the investigation based on your report and the consideration of further actions to be taken.
By filing a report, you acknowledge and accept the provisions of the Policy.
Your report will be received by a dedicated investigation committee. If you have provided your personal contact details, you will be contacted within 7 working days from the date of receipt in order to investigate the details of your case during an personal interview. Your personal cooperation is required to contact and hear you.
Because of its obligation to document, the committee will create a record of the complaint, which will be signed by both the complainant and the members of the investigation committee.
If the content of the report appears to be substantiated, the committee will open an internal investigation.
The official report on the complaint and the person interview will be archived. If the investigation of the reported conduct warrants the initiation of criminal proceedings, we will ensure that charges will be filed.
During the investigation of the reports, the Employer shall act in accordance with the relevant rules of the Law and the Policy.
No, we are obliged to process the data entered into the reporting mechanism with the utmost discretion and protection. With this in mind:
• during the course of the report investigation, we may process the personal data you voluntarily provided and the data relating to a third party, including sensitive data and personal criminal records, only for the purposes of investigating the report and remedying or stopping the conduct that is the subject of the report and may transfer it to the whistleblower protection lawyer or to an external organisation involved in the investigation of the report,
• data processed under the reporting mechanism may be transferred to another state or international organisation only if the recipient of the transfer has made a legal commitment to comply with the rules on reporting set out in this Law,
• the reporting mechanism is designed in such a way that the identity of non-anonymous complainants is not known to anyone other than the investigators. Until the investigation is closed or formal proceedings are initiated as a result of the investigation, investigators investigating a complaint report shall keep confidential the information on the content of the report and the persons involved in the report, and shall not disclose such information to any other organisational unit or employee of the employing organisation, except to the person invoolve in the case.
As we also accept complaints anonymously, you are not obliged to provide your personal data below, you can file a report without filling these in. However, we request that you provide as much detail as possible to ensure that the investigation is conducted efficiently.
